Terms of Service

These terms apply to your use of the Shared Wines platform. By creating an account or using the platform, you accept them.
1. Who we are
Shared Wines is an initiative by Arno Gregorian, operated through Webroots B.V., registered at Delistraat 8, 1094CV Amsterdam, the Netherlands. Contact: arno@webroots.nl.
The platform runs on sharedwines.com and gives private collectors and wine merchants the tools to catalogue, share, and sell their wines.
2. Scope
These terms apply to anyone visiting or using the Shared Wines platform. Customers of shops hosted on Shared Wines are additionally bound by the shop owner's own terms. If the two conflict, the shop's terms govern the sale transaction; these terms govern your use of the platform itself.
3. Accounts
Accounts are bound to an individual or legal entity. You must be at least 18 (wine is not legally available to minors in the Netherlands). Provide accurate information and keep your credentials confidential.
You are responsible for all activity under your account.
4. Acceptable use
You may not use Shared Wines for:
- Illegal content, counterfeit goods, or promotion of wines whose provenance cannot be lawfully established
- Spam, automated scraping, or stress-testing the platform
- Circumventing payment limits, payment fraud, or reselling platform access
- Attempting to bypass security mechanisms or access other accounts
- Uploading content that infringes third-party rights (copyright, trademark, image rights, etc.)
5. Fair-use limits
To keep the platform affordable and stable for everyone, the following limits apply per account per calendar month:
- Up to 500 new wines created per month
- Up to 20,000 unique visitor sessions per shop per month
- Up to 500 completed online payments per shop per month (Premium Shopping)
6. What happens beyond fair use
We operate a fair-use policy and always try to reach out before imposing restrictions. For sustained heavy use we may propose a higher plan, apply rate limits, or in extreme cases temporarily pause features. Previously created content (wines, shop, orders) stays accessible.
7. Subscriptions, billing, cancellation
Shared Wines offers a free tier and two paid tiers: Premium (€5/month or €50/year) for unlimited wines and a custom domain, and Premium Shopping (€20/month or €200/year per shop) for online payments. Prices include VAT where applicable.
Subscriptions renew automatically until cancelled through the Stripe Billing Portal. We do not refund unused portions of a paid period. You can cancel any time; access continues until the end of the paid period.
Subscription payments to Shared Wines are processed by Stripe. Shared Wines issues invoices for paid subscriptions.
8. Online payments (Premium Shopping) — liability carve-out
When you activate Premium Shopping you connect your own Stripe or Mollie account to your shop. Customers pay directly into your account; Shared Wines does not receive or hold customer funds and is not a party to the sale transaction.
Stripe and Mollie are independent payment processors with their own terms. Shared Wines is not liable for:
- Outages, delays or errors on Stripe's or Mollie's side
- Declined payments, chargebacks or fraudulent transactions
- Delayed or non-existent payouts by the payment processor
- Errors in your VAT configuration or invoicing
- Disputes between you and your customers about delivery, quality or returns
- Restrictions or account suspensions imposed by Stripe or Mollie
9. Availability and maintenance
We do our best to keep Shared Wines available 24/7, but we provide no uptime guarantee and explicitly exclude any service-level agreement. Planned maintenance windows are announced in advance where possible. For unplanned outages we work to restore service; we are not liable for lost revenue or indirect damages caused by downtime.
10. Data, ownership and processing
You retain full ownership of the content you upload (wine data, photos, descriptions, customer data, etc.). You grant Shared Wines a non-exclusive, royalty-free license to host and display that content as needed to operate the platform.
Personal data is processed in line with GDPR and our privacy policy. For data belonging to your customers you are the controller and Shared Wines acts as processor. We will enter into a data processing agreement on request.
11. Liability
Shared Wines is only liable for direct damages caused by an attributable breach by Shared Wines, capped at the total subscription fees you paid in the 12 months preceding the event causing the damage.
Liability for indirect, consequential or incidental damages, lost profit, missed savings, data loss or reputational harm is excluded, except in cases of willful misconduct or gross negligence.
12. Termination
You can close your account at any time from account settings. Shared Wines may suspend or terminate an account for breach of these terms, persistent non-payment or suspected fraud.
After termination we provide a reasonable window to export data. We may then delete content, subject to legal retention obligations (e.g. invoicing records).
13. Changes
We may amend these terms from time to time. Material changes are announced at least 30 days in advance by email or in-platform notice. Continuing to use the platform after the effective date constitutes acceptance.
14. Governing law and disputes
These terms are governed by Dutch law. Disputes will be submitted to the competent court in Amsterdam, unless mandatory law designates a different court.
